Bulgarian and Romanian Nationals

On the 1st January 2007 Bulgaria & Romania joined the EU, which meant
nationals from these two countries no longer needed to apply for an entry visa to
the UK. These nationals can freely enter the UK, but the UK Border Agency has put
in place restrictions on who can work under a Contract of Service (Pay As You Earn
Employment). A2s do not fall under the Points Based System.

If you are a highly skilled Bulgarian or Romanian national you are permitted to apply for a BR2 if you meet the UK Border Agency (UKBA) requirements. This page gives you an outline of whether you think you qualify or not.
Bulgarian or Romanian national intending to take employment in the United Kingdom who is subject to the requirement to hold an Accession Worker Card.
Employment Start Date
You must not start work until you receive your Accession worker card. If you are prosecuted and convicted of working without an Accession worker card you could face imprisonment for up to 3 months or a fixed penalty of £1000.
Below are the options open to you if you wish to apply under BR3
- You can apply as the holder of a letter of approval issued to your employer by the UK Border Agency under the work permit arrangements, or
- If you already hold an Accession Worker Card for one employer and wish to change to another employer, or
- You can apply as a member of the airport-
based operational ground staff of an overseas airline, or
- You can apply as an employee of an overseas government or international organisation.
- You can apply as a representative of an overseas newspaper, news agency or broadcasting organisation.
- You can apply as an Au pair.
- You can apply as a domestic worker in a private household.
- You can apply as a private servant in a diplomatic household.
- You can apply as a minister of religion, missionary or member of a religious order.
- You can apply as a sole representative of an overseas business.
- You can apply as a teacher or language assistant on an exchange scheme.
- You can apply applying as an overseas qualified nurse or midwife undertaking a period of supervised practice or adaptation training.
- You can apply as a postgraduate doctor, dentist or trainee general practitioner.
