Turkish nationals can apply to enter or stay in the UK if they want to establish themselves in business, and the residency rights of Turkish workers who are already here.


If you are a Turkish national, you have 3 routes you can apply under:

  1. Businesspersons
  2. Workers
  3. Dependants


What is the criteria to enter the UK under the Turkish agreement?

Under the European Community Association Agreement (ECAA) with Turkey, you have certain rights if:


Businesspersons

If you are a Turkish national and you want to establish yourself in business in the UK, you can apply to come to or remain in the UK under Turkish ECAA business category.

If you meet these requirements, you can apply to enter the UK in the Turkish ECAA business category, or to switch into this category if you are already here legally in a different category. We will consider your application under the business provisions that were in place in 1973.


Workers

Turkish nationals may benefit from the European Community Association Agreement (ECAA) with Turkey if they are already working legally in the UK and want to extend their stay.


If you are a Turkish national who is legally employed in the UK because you have a visa that gives you permission to work, a decision by the Association Council of the ECAA has given you certain rights. You may:


Dependants

If you are a family member (dependant) of a Turkish national who is established in business or working in the UK you can apply as their dependant under the provisions of the European Community Association Agreement (ECAA) with Turkey.

Note: A dependant is the husband, wife, civil partner, unmarried partner, same-sex partner or child of a person who has valid permission to be in the UK under the ECAA.


There are 2 ways of applying to extend your permission to remain as a dependant:


If you are already working here legally

A decision by the Association Council of the ECAA gives certain rights to Turkish nationals who are already working legally in the UK.


What is my immigration status while my application is being decided?

If you make an application before your authorised stay ends, your existing immigration status will continue until your application is decided, even if the decision is not made until after the end of your permitted stay. If your existing visa or other permission to stay here allows you to work, you can continue to do so until your case is decided.
