To apply under 'Private Life', you need to be living in the UK

Private life falls under 4 categories:

Aged under 18, lived continuously in the UK for 7 years
Aged 18-24 and lived continuously 50% of your life in the UK
Over 18 and have spent less than 20 years in the UK
25 or over and lived continuously in the UK for 20 years

7 Year Route

How can I apply under this route and what are my chances of obtaining a visa as a child? 

This route allows children aged 17 years of age or younger to remain in the UK if they have lived continuously in the UK for 7 years.

If the child complies to this, the parent or parents would be expected to remain in the UK under this route by adding themselves to the visa application form.

This visa application is a little bit more complex as you would be expected to provide evidence per child and per parent and each family circumstances can be very unique so do not read a blog and think, if that was good for then, it must be good for us. Visa fees are not refundable if you get it wrong.

What visa form do we need to use?
If the child complies to this application guidelines and all the right original supportive documents are in order, you complete FLR (FP).

You will be expected to provide certain evidence in original format that includes where the child is living and has lived, the financials that supports the child's UK stay, who are the parents and their responsibilities and child's education and if applicable medical condition.

Under this form you have to demonstrate, if the child's visa was refused, what impact would it have on them and the child's family if they had to leave the UK.

Aged 18-24

Applying under private life if aged 18-24

To be able to apply under this application route, you need to be aged 18 to 24 when the application is submitted to the Home Office. 

You must have lived in the UK 50% of your life. 

This means if you are aged 20 today, you must have been living in the UK not a day less than 10 years.

The tricky bit could be if you spent any time in prison or trips out of the UK, short trips like holidays is not an issue, but if you lived abroad for a period of time, this would need to be investigated and checked to see what impact it would have on your application.

Paragraph 276ADE(1)(iii) Family Migration - Appendix FM Section 1.0 covers this in greater detail but you must have had continuous residence in the UK and if you have been out of the UK for 6 months or more in any one period, you may have an issue complying to continuous residence in the UK unless you can justify why you were out of the UK.

Over 18 (20 Year Route)

Applying under private life if aged 18 and over and lived less than 20 years in the UK

To be able to apply under this application route, you need to be aged 18 to 24 when the application is submitted to the Home Office. 

You must have lived in the UK 50% of your life. 

This means if you are aged 20 today, you must have been living in the UK not a day less than 10 years.

Paragraph 276ADE(1)(vi) Family Migration - Appendix FM Section 1.0 covers this in greater detail but you must be aged 18 or over at the time of the application, have lived continuously in the UK for less than 20 years and you can demonstrate obstacles that at the time you submitted this application, you have significant evidence to demonstrate obstacles to integrate into the country you would have to return to, if your application was refused.

20 years Continuous Residence

Applying under private life if lived 20 years in the UK

To be able to apply under this application route, you need to have lived in the UK continuously for 20 years when you submit your application. If you have been in prison, this does not count towards your 20 years.
