  • Administrative Review

    CAN I CHALLENGE THE HOME OFFICE?

    If your application has been refused or you disagree with your approval decision, it can be confusing which direction you can go in.


    If you are  allowed to do an 'Administrative Review' (AR) but not sure how to do it, we can help you.


    Before processing the AR, it might be possible to carry out a 'Reconsideration Request', this is where you can ask for your AR or appeal to be first reviewed.


    When you read the Home Office refusal letter, you could disagree with one or many of their reasons to refuse your application.


    It is important to decide if the reasons are genuine, if errors made by the Home Office or an immigration rule you feel is ambiguous and should be challenged.


    You should obtain legal advise to help you understand the rules and whether you have a case to challenge.


    This page will explain whether you can process an AR inside or outside of the UK and explains what a Reconsideration Request is.

  • EEA Applications

  • PBS Dependants

    This visa route is for non-EEA nationals joining their family member in the UK if they hold a valid.


    Tier 1, Tier 2, Tier 4 or Tier 5 visa

    These 4 tiers fall under the Home Office points-based system introduced in 2008.


    Tier 1 Highly Skilled | Tier 2 Skilled Workers | Tier 4 Students | Tier 5 Temporary Workers.


    If you're are applying under this visa route, your UK stay is based upon your Tier 1, Tier 2, Tier 4 or Tier 5 visa status whilst you're in the UK.


    You can apply under your own visa route if open to you, then you are not reliant on your partner.

  • Representative of an overseas business

    A representative of an overseas business is a non-EEA national wanting to come to the UK to represent a foreign business that wants a presence in the UK.


    The sole representative of an overseas company planning to set up a UK branch or a wholly owned subsidiary for an overseas parent company or become an employee of an overseas newspaper, news agency or broadcasting organisation posted on a long-term assignment to the UK.


    If the overseas business already has a UK presence, you cannot apply for this visa unless you are replacing the person that was previously representing them.

  • Returning Resident

    If you previously held a document called 'Indefinite Leave to Remain' and you left the UK for two years or longer or you lost your document, you will need to apply under 'Returning Resident'.


    This section covers the eligibility you will need to meet and what you should do if you been away from the UK for more that two years


    We will also cover family members, if you are part of the UK armed forces, under diplomatic service, a UK-based British Council employee, Home Office employee or DFID employee.

  • Right of Abode

    Who can apply under Right of Abode (RoA) to enter the UK?


    RoA is only gained through your parents.


    If you are entitled to a RoA, it means you are allowed to live and work in the UK without any immigration restrictions and it also means you do not need a visa to enter to live in the UK and there is no time limit on the length of time you can spend in the UK.

  • Settlement

    Settlement status is only obtained once the person qualifies.


    In most cases settlement is obtained once the person has resided in the UK for 5 years but in some applications settlement can be applied for just after two years.


    Once settlement status has been obtained, you then can apply for naturalisation within the agreed period.


    You can obtain settlement status in many ways, this page will cover various routes open to you and they include working under the points based system, sponsored by a UK settled person, UK ancestry visa, retired person, bereavement, been in the HM Forces, discretionary leave, granted asylum, private life, long residence and EEA approval certificates to name a few.

  • Students

    Their are 3 types of student visas you can apply under, they are: 


    • Tier 4 General visa
    • Tier 4 Child visa
    • Short-term visa

    These 3 visa types have specific immigration rules associated to them so you need to ensure you meet these visa guidelines and check if you have to apply outside or within the UK.


    You also need to make sure the training institute has a valid sponsor licence.

  • Tier 2

    Tier 2 visas are part of the points-based system for skilled individuals.


    This Tier was first introduced to the UK in November 2008.


    If you meet the immigration rules of this visa route, a UK employer (sponsor) is required to work in the UK and all visas will require a 

    Certificate of Sponsorship being issued first from a UK sponsor.


    Since the launch of Tier 2, a number of changes have been made such as Restricted Certificate of Sponsorship, Intra-company Transfer,  Immigration Skills Charge, Priority visa service to name a few. LEARN MORE>>

  • Tier 5

    Tier 5 visas are part of the points-based system for temporary individuals wanting to work in the UK.


    THIS TIER WAS FIRST INTRODUCED TO THE UK IN NOVEMBER 2008.


    Temporary workers need a UK sponsor and the sponsor must be their employer (excluding certain countries under Tier 5 Youth Mobility Scheme}.


    A sponsor in most cases must carry out a UK Resident Labour Market Test (job advertisement), then issue a Certificate of Sponsorship (CoS) to the worker.


    Different rules apply for Charity Workers and the Youth Mobility Scheme to other Tier 5 visas.


    Tier 5 visas are only issued for 12 or 24 months and cannot be extended beyond their respective permission periods. LEARN MORE>>

  • Turkish

    Helping Turkish nationals to enter or remain in the UK and settle.


    Turkish nationals can enter and remain in the UK under the Ankara agreement.


    You can apply under Turkish business person, Turkish worker and Turkish family member.

  • UK Ancestry

    UK Ancestry visa is only issued to Commonwealth Citizens.


    To apply for a UK ancestry visa you need to apply from outside of the UK via the approved Home Office online visa portal.


    IF YOU NEED TO EXTEND THIS VISA, YOU CAN FROM WITHIN THE UK.


    You will need to prove that one of your grandparents was born in the UK and you will work in the UK if your visa application is successful.

  • Visitors

    Visit visas are governed by types, they are:

    • Tourism
    • Child
    • Family
    • Business
    • Marriage
    • Civil Partnership
    • Private Medical
    • Other Types.

    Visit visas can be assigned from 1 month to 10 years, it all depends on the type you apply under.


    DID YOU KNOW THAT A HIGH PERCENTAGE OF VISIT VISAS ARE REFUSED?
