WHAT DOES OUR EXPERT THINK OF THIS HOME OFFICE UPDATE?

If you need to apply for an AR, you can only apply under this if your application was refused under Appendix EU. If you received a refusal letter and it lists rules like these ones:
  • EU6 of Part 1 of Appendix EU
  • EU11 or EU12 or for limited leave to enter or remain under paragraph EU14
  • Paragraph ETLR5 of Part 2 of Appendix EU
  • paragraph AR(EU)1.1. also includes a decision made under paragraph 321B of Part 9 of these Rules
  • Paragraph EU6 of Part 1 on suitability grounds as set out in paragraph EU15 or EU16
  • Paragraph ETLR5 of Part 2 on suitability grounds as set out in paragraph ETLR12, ETLR13 or ETLR14
  • Paragraph EU10(1) of Part 1 or under paragraph ETLR10(1) of Part 2

WHAT DOES OUR EXPERT THINK OF THIS HOME OFFICE UPDATE?

If you are a non-EU national and your family member is a EEA national, then this could apply to you. These rules cover area such as spouse, civil partner and durable partner. They also cover document evidence, immigration issues such as deportation, exclusion orders, children adopted, children aged 21 whereas other immigration rules children are deemed under 18.

If you an unmarried partner you used to be classed as an extended family member but now you are classed as an 'Durable Partner'. You must hold either a family permit or residence card.
