Each tier of the points based system you need certain total in attributes, example under Tier 2 (General) you need 50+10+10, a total of 70 whereas Tier 5 (Religious Worker) you need 30+10, a total of 40.

This latest Home Office news covers 'codes of practice' ensuring sponsors and migrants complies to the immigration rules.

This update covers 11 sections covering the SOC codes the tier worker could fall under.



WHAT DOES OUR EXPERT THINK OF THIS HOME OFFICE UPDATE?

SOC codes were introduced in 2008 under the new points-based system. A SOC code represents a type of job, example 5434 SOC code covers all areas of chefs. Job descriptions and job titles can vary so the Home Office will expect the job description offered to the sponsored workers falls under of the the 4-digit SOC codes.

At present to work under Tier 2 General, your SOC code must be at RQF Level 6. This could be scrapped when the UK departs the UK as Tier 2 General may be permitted at RQF level 3.

Some jobs fall under the Shortage Occupational List, this simply means less rules apply to these 4-Digit SOC codes.

STATEMENT OF CHANGES IN IMMIGRATION RULES

Changes to Tier 1 Entrepreneur visa route

'My rt hon Friend, the Home Secretary, will shortly be laying before the House a Statement of Changes in Immigration Rules.

The Government is clear that entrepreneurs play a key role in creating jobs and driving economic growth, which is vital to the prosperity of the UK. In June of this year, the Government announced a new Start-up visa route. This will build upon the successes of the current Tier 1 (Graduate Entrepreneur) route, expanding it to ensure that the UK can benefit from a wider pool of overseas talent looking to establish new businesses in the UK. Applicants will be endorsed by either a business or higher education institution sponsor.

We are announcing that we will build on this offer further by introducing a new Innovator route, for more experienced business people. This will replace the current Tier 1 (Entrepreneur) route and have a similar emphasis on endorsement by a business sponsor, who will assess applicants’ business ideas for their innovation, viability and scalability.'



WHAT DOES OUR EXPERT THINK OF THIS ANNOUNCEMENT?

Since May 2008 when Tier 1 was first introduced, the Home Office has made several changes such as Tier 1 General and Tier 1 Post Study Work visa routes being closed due to migrants abusing the visa route.

We are not surprised that Tier 1 Entrepreneur is being restructured as many entrepreneurs who are granted their initial visa find it very hard to make their UK business a success. Running a business in any country has so many more challenges than running a business in your home country.

We expect the new visa changes to come into force from 6 April 2019. This is when the Home Office publishes the majority of new immigration rules. 

At present Tier 1 Graduate Entrepreneurs need a UK-recognised bachelor’s degree, master’s degree or PhD awarded before the date of endorsement and must come from an authorised UK higher education institution issued in the past 3 months or obtain endorsement by the Department for International Trade (DIT).

It is widely expected that Tier 1 Entrepreneur will be renamed to 'UK Start Up Visa'and 'Innovator Visa' for more experienced business people. Like with Tier 2 General, you have 'Entrant' and 'Experienced' levels depending on your experience level.
